Украинский адвокат подал иск к КНР на миллиарды гривен из-за распостранения коронавируса в Украине

Сегодня направили в суд исковое заявление о взыскании убытков, нанесенных украинцам  действиями властей разных государств, в связи с тем, что пандемия COVID-19 является прямым результатом нарушений и обмана, совершенных властями КНР, а также всех государств, которые, получив сведения о возможном распространении эпидемии опасной болезни, считали целесообразным скрывать и преуменьшать реальные масштабы ее распространения, причинившее вред гражданам Украины и бюджету Украины на миллиарды гривен. Истцом выступила Общественная организация «Правовое партнерство Украины» в лице руководителя, адвоката Касьяненко Дмитрия.

Предполагаем, что противоправные действия руководства КНР привели к инфицированию COVID-19 и смерти сотен тысяч людей по всему миру, поскольку те стремились минимизировать последствия, участвуя в прикрытии и введении в заблуждение общественных связей,  уменьшая ценность исследований и отказавшись от сотрудничества с мировым сообществом, что сопровождалось нарушением международных стандартов здравоохранения.

Ответчиками также есть:

  • Министерство здравоохранения Украины
  • Кабинет Министров Украины
  • Служба безопасности Украины
  • Офис Генерального прокурора

Обращаем особое внимание Суда на то, что Министерством здравоохранения Украины и Кабинетом министров Украины не было должным образом обеспечено выполнение введенного в Украине стандарта выявления и лечений больных COVID-19, а также защиты медицинского персонала .

Истец подал иск к органам государственной власти Украины и предполагает, что в их действиях не усматривается достаточного количества мероприятий, направленных на противодействие распространению такого вируса COVID-19 и надлежащего реагирования на текущую ситуацию, последствия которой могут негативно отразиться на экономическом и социальном благополучии населения, а также объективную необходимость устранения рисков распостранения опасной инфекции.

Обращаемся в суд с данным исковым заявлением, в котором просим признать противоправной бездеятельность Министерства здравоохранения Украины, Кабинета Министров Украины, Службы безопасности Украины, Офиса Генерального прокурора о принятии мер по противодействию распространению на территории Украины коронавируса CoVID-19 и защиты населения от возможных последствий и обязательств совершить действия.

Учитывая масштаб последствий, которые наступили для социально-экономической жизни государства и его граждан, считаем необходимым указать на значительную степень недобросовестного отношения к своим обязанностям и офиса Президента Украины, что проявилось, в частности, в отсутствии должного анализа и контроля политических, экономических, социальных, гуманитарных и других процессов, происходящих в Украине и мире, в то время как по закону именно на Офис Президента возложена, среди прочего, функция подготовки по результатам такого анализа для представления на рассмотрение Президенту Украины предложений по вопросам формирования и реализации внутренней и внешней политики государства.

NON-GOVERNMENTAL ORGANIZATION “UKRAINIAN LEGAL PARTNERSHIP” 

Dear Sirs,

Global health experts are increasingly coming to the same conclusion: the novel coronavirus 2019 will circle the globe. We are well aware of USAID to be responding to the COVID-19 pandemic with decisive action at home and abroad. Our priorities in the COVID-19 response are to protect the safety and health security of our global workforce, ensure that we can continue our life-saving mission across the world, and support partner countries in their response to COVID-19.
Non-governmental organization Ukrainian Legal Partnership filed a lawsuit against the Chinese Government on behalf of all people living in Ukraine, residents and businesses in the Ukraine, including, we seek to protect the rights and interests of American citizens in the territory of Ukraine as well.
The lawsuit is currently pending in the Kyiv District Administrative Court, and seeks for recognition illegal the Chinese government’s inaction in counteracting the spread of the virus and compensatory damages for those who have suffered personal injuries, property damage and other damages due to China’s failure to contain the COVID-19 virus, despite their ability to have stopped the spread of the virus in its early stages.
In our statement of claim, we point out that the COVID-19 pandemic is a direct result of abuse and deception committed by the authorities of the People’s Republic of China, as China’s policy, despite the first known cases of the virus in November 2019 and human-to-human transmission, was aimed at minimizing the consequences by participating in the cover-up and misleading of public relations, ordering to reduce the value of research and refusing to cooperate with the world community, which was accompanied by violations of international standards for protection public health.
The whole world is now demanding a response to the pandemic, which has led to the closure of businesses, the disruption of the usual mode of production and trade, and the relocation of workers.
The number of victims of the threat of spreading the disease and its direct spread is critically high, as are the economic losses, which include job losses, reduced incomes and lost business opportunities.
Within the stated requirements of the lawsuit, we also seek to recognize the illegal inaction of the responsible Ukrainian authorities, as the damage significantly affected the lives, health and safety of many Ukrainians, destroying lives and damaging public order and the economy of Ukraine. The consequences of inaction have led to violations of the rights of all, without exception, people living in Ukraine, regardless of origin and citizenship. In accordance with Ukrainian legislation, NGO Ukrainian legal partnership seeks to : 1) oblige the Cabinet of Ministers of Ukraine to develop and implement relevant state programs and sanitary and anti-epidemic rules; 2) oblige the Ministry of Health of Ukraine to ensure the necessary public procurement and the conduct of clinical trials of drugs and examination of clinical trial materials in order to prevent the spread of coronavirus COVID-19 in Ukraine.
Considering the above, we seek to build partnerships that leverage the combined skills, assets, technologies and resources of the public, private and nonprofit sectors to deliver sustainable development impact in order to enable us to achieve more working together. In this case we would like also to kindly ask for cooperation on the issue in Ukrainian courts as NGO Ukrainian Legal Partnership looks forward to fighting for the rights of individuals and businesses in Ukraine and all around the globe. People are now susceptible to infection and are becoming sick themselves or caring for another people, dealing with financial calamity, and dealing with panic, social distancing, isolation and lack of personal protective equipment.
We are interested in supporting the US-initiated processes related to the coronavirus including those to protect people in Ukraine and USA, as well as in mutual cooperation in lawsuits against China’s illegal actions regarding the spread of coronavirus throughout the planet, development of medical institutions and research laboratories. We urge to use all means to protect our citizens in order to impose on the governmental structures of the People’s Republic of China the obligation to pay all civil damages and restitution established by international law and the national law of each of our countries.
We would like to proceed promptly, to secure the testimonies of witnesses and take copies of all relevant documents for further custody or control whether physically in Ukraine or outside Ukraine). NGO “Ukrainian Legal Partnership“ is currently preparing all the evidence for filing the documents in the appropriate Courts of civil and administrative jurisdiction on the protection of patients and approximately 100 thousand citizens who were at the direct risk. Within the process we arrange and prepare questions for expertise and legal base for testimonies.
Currently NGO “Ukrainian Legal Partnership“ works on the issue of construction of special hospitals and scientific research facilities for providing the development and testing of the special equipment for relevant studies.
Within the case we have a net of partners, including in the USA and European countries, e.g. who are professional manufacturers specialized in producing prefab houses with production bases within Europe and Asia, sales and service network cover up to 200 key cities and regions. Their products exported to more than 100 countries and regions: Southeast Asia, Middle East, Africa, Europe, America, Australia, etc.
We believe that a normal epidemic hospital, especially one equipped to handle several diseases, could be constructed as temporary so the flat pack house style construction of the hospital is the most suitable because they are easily and quickly assembled and can be dismantled. Once they’re dismantled, they can be reused and/or they can be transported by truck to other cities where they’re needed or the company may provide the recycle of the steel and other useful materials used in the flat pack houses (the example of approximate calculation of a part of our project is attached to this letter).
Building partnerships with NGO Ukrainian Legal Partnership is intended for defining a shared vision of what we want to achieve together, and then co-creating a partnership that taps into the respective strengths of different partners sharing the risks, responsibilities and rewards within the core interests of all parties involved.
We are also actively working in partnership with a variety of multinational corporations, local businesses, NGOs, government agencies and other donors in Ukraine and abroad. Considering this matter, during the extensive media campaign we are conducting in Ukraine, we would like to agree with you on the possibility of public coverage of information about our coordinated actions for widespread publicity. In terms of this issue, perhaps the most successful is also the coordination of funding for our joint activities.

Да, было бы интересно узнать, чем закончится. Жаль, что откажут по формализму или просто затрут…. Но Дон Кихот нашего времени – это здорово!

Згідно з дослідженням групи американських та британських вчених, якщо б Китай, який запровадив карантинні заходи, зробив це на тиждень раніше, він би міг попередити 67% заражень – якби відреагував відразу, на початку січня, захворіло б лише 5% від нинішніх хворих. Дані з інших міст також показують, що діяти треба якомога швидше і якомога рішучіше. Міста, в яких зупинили роботу громадського транспорту, закрили розважальні заклади та заборонили громадські зібрання ще до появи першого випадку захворювання на території міста, мали на 37% менше випадків хвороби.
