In the process of registering a TM, the territorial feature is always taken into account, this means the zone where the brand will be under reliable protection. Therefore, to protect a trademark, a separate registration procedure is required, it can take place both for each specific country and for a specific region (for example, the European Union), international registration of a trademark. To simplify international trademark registration, we recommend using the so-called Madrid system.
The presented system operates based on the Madrid agreement and the attached Protocol to this agreement. There are 105 participants in this system, representing 121 countries.
The list of main features of international registration includes: centralized office management, as well as the only established procedure for registering a TM. This process has a certain list of advantages:
- Registration and submission of one application, which will indicate 121 countries (countries that are included in the Madrid system).
- High-quality protection of TM throughout the territory of the selected foreign state, which is not inferior to the protection of national scales.
- The application is submitted in any of the three official foreign languages-English, Spanish or French. This does not require translation into the languages of the countries where the stamp will be protected.
- It is not necessary to use national patents in each new country.
- A single set of fees is indicated in Swiss francs. Thus, participants are exempt from paying state duty in each country separately.
- Immediate territorial expansion of TM protection immediately after the registration procedure is completed.
To get acquainted with the exact cost of international registration, it is important to take into account the exact number of classes, pay attention to which version of the TM is requested-color or black-and-white version, and also take into account the number of countries where protection of goods or services will be extended.
