Restoration of documents by a lawyer

Documents tend to get lost, deteriorate, or damaged, leaving the owner without the ability to do anything with the property.

According to the legislation of Ukraine, the loss of documents does not mean the loss of ownership of the object.

A lost document can be restored by getting a duplicate in the hands of the government agency that issued the original. The procedure may be somewhat delayed, which may cause a prolonged sale of the object or other difficulties in its operation.

To restore the certificate of registration of the right to real estate, and additional newspaper is attached to the application from the owner with an announcement of the loss of the document and a request to consider the lost document invalid.

Loss or damage to a document issued by a public notary requires its restoration through the state notary archive. If the document was damaged or lost, seen by a private notary, or the document was transferred to him, but not yet transferred to the state notary archive-the private notary can issue a duplicate himself.

It is not always possible to get a duplicate of the lost title documents for a number of reasons. In this case, the owner of the title document can submit a claim to the court for recognition of ownership of the real estate. The court’s decision, in this case, will act as this legal document.

After restoring the lost document through the procedure of obtaining a duplicate of it, at the last stage, the duplicate itself is registered in the State register of real estate rights.

Restoring the title document and making a duplicate is a very lengthy procedure. A person who is faced with such a procedure for the first time and is not familiar with the work of state authorities will face many difficulties.
