What points should be taken into account when registering a plot?

High-quality, and correct registration of the transaction when purchasing a land plot is the key to the successful acquisition of land ownership, which will not cause further legal difficulties, and problems. There are certain nuances that will help both the seller and the buyer not to get into an unpleasant situation.

→ The first thing you need to do is check the registration of the land plot so that in the future you do not spend time, and nerves on the privatization process, the need for which for some reason was not taken into account when concluding a land purchase transaction.

→ The second point is to study the purpose of the land plot. As an example, if you buy a plot of agricultural land, and build a house on it, the new owner will not be able to register in it, since the intended purpose of the land will not allow you to do this. Of course, the intended purpose can be changed but you must understand that this is also an additional waste of time, and effort. Moreover, there is no guarantee that you will get approval to change your intended purpose.

→ The third aspect is to take care of drawing up a preliminary contract between the buyer, and seller of the land plot. This agreement must precede the main agreement, and contain information about the terms, and conditions of the purchase, and sale transaction. This document also contains the transaction price, and payment procedure, as well as the date of transfer of ownership.

The current legislation of Ukraine defines the following methods of registration of property rights, which depend on how the land was acquired:

  • in the order of inheritance, exchange, purchase, gift;
  • through the privatization of land that was previously owned by the state;
  • through the transfer of land to a legal entity as authorized capital.
